Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the app operated by Tucumah LTD, registered in England & Wales (Company No. 16199141) with its registered office at 71‑75 Shelton Street, Covent Garden, London, WC2H 9JQ ("we", "us", "our"). The app helps sports clubs register members, track attendance, and manage fees.
2. Your Responsibilities
- You (the sports club) are responsible for the accuracy of all data you enter—including member details, attendance records, and payments.
- You confirm you have all necessary consents and legal rights to collect, process, and manage personal data in compliance with applicable law, including the GDPR.
- You are responsible for communications with your members regarding fees, refunds, and any legal disputes.
3. Indemnity
You agree to indemnify and hold Tucumah LTD harmless from any claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising out of or related to:
- Your use of the app;
- Disputes between you and your members;
- Any misuse or inaccurate entry of data;
- Any failure by you to comply with GDPR or other applicable law.
3A. Payments and Fees
Tucumah LTD facilitates payment processing on behalf of clubs. We are not a party to the contract between clubs and their members.
Clubs are fully responsible for:
- all transaction fees, service fees, and administrative costs charged by payment processors;
- any chargebacks, reversals, or disputes raised by members or their banks;
- refunding or settling disputes directly with members.
If Tucumah LTD incurs costs in relation to chargebacks, disputes, or unpaid fees connected to a club's transactions, the club agrees to reimburse Tucumah LTD in full.
Right of Set-Off: Tucumah LTD reserves the right to deduct any fees, chargebacks, or costs owed by the club from future payouts. If sufficient funds are not available, Tucumah LTD may issue an invoice for the outstanding amount, payable on demand.
4. Limitation of Liability
We provide the app "as‑is" and do not guarantee uninterrupted, error‑free service.
We are not responsible for:
- Data inaccuracies or loss due to user error;
- Disputes between clubs and members;
- Any indirect, incidental, consequential, special, or punitive damages, even if advised of the possibility of such damages.
Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding any claim (if applicable).
5. Service Availability & Maintenance
We aim to maintain the app's availability and security, but make no warranties regarding uptime or incident-free operation. We may perform maintenance or updates without prior notice.
6. Changes to Terms
We may update these Terms at any time. Continued use of the app after changes are posted constitutes acceptance of the revised Terms.
7. Governing Law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of its courts.
